Welcome to Tracksaudio website. In terms of use, we refer to the website, applications, and our services collectively as the “Platform”.
This is a legal agreement between you and the Company. The terms apply to the Platform (regardless of the way of access or use) and for other interactive features and applications provided by us or available through us.
Please read the terms of use carefully, as well as our Privacy Policy which includes our Cookie Policy.
By using the platform and our services, you accept the practices described in the terms of use and privacy policy. If you do not agree with these terms, please do not use the platform. We reserve the right to modify or amend the terms of use and privacy policy from time to time with further notice. Continuing to use our platform and any linked website/platform after posting of changes means you accept those changes. Furthermore, you agree to comply with all local, regional, national, and international laws, regulations, ordinances, and statutes that apply to your use of the platform or the content (as defined below). By using this platform, you agree to these terms and conditions and declare that you have read and understood the terms of use, intend to adhere to them, and that you are 18 years of age or older. Additionally, from time to time, we may release new tools and resources on the platform, or introduce other services and/or features for the platform. Every new service and feature will be subject to the terms of use as well as any additional terms and conditions that may be released for those specific services or features.
Regarding the users:
You must register for a user account in order to gain access to use Tracksaudio’s Exclusive Services. You agree to:
Provide true, accurate, current, and complete information about yourself as prompted by the registration form.
Maintain and promptly update the registration data to keep it true, accurate, current, and complete.
It is forbidden to share an account with other users for the subscription services of Play Exclusive.
All subscribed users of the platform can have access from any device or location.
By starting your exclusive subscription, you can have access to Tracksaudio’s music channels. You are entitled to access from two points (IP connections). Therefore, you must be particularly careful of its use.
Further attempts to access more than one stream simultaneously from multiple locations or devices may result in temporary or permanent restricted access to the music stream.
More than two connections from a single subscribed account are prohibited. If your account is blocked, please contact us to unlock it. For the need to use more than two points simultaneously, you will need to create a new subscription with a new username.
The Platform provides a limited selection of free content to users who choose not to subscribe to an account.
Intellectual Property:
All content presented or displayed on the platform, including texts, graphics, photographs, images, sound, and illustrations (“Content”), belong to the Company, its licensors, its suppliers, and content providers. All elements of the platform, including, without limitation, its overall design and content, are protected by copyright laws, moral rights, trademarks, and other laws relating to intellectual property rights. The platform may only be used for the purpose for which it is intended. You are authorized to display and reproduce the sound found on the platform for personal, informational, and non-commercial purposes only. Modifying any material, as well as copying, distributing, transmitting, displaying, performing, reproducing, publishing, licensing, transferring, or selling any information or work contained on the platform, is not permitted.
You must not collect or attempt to collect personal data or any other type of information about other users, including, without limitation, through spidering or any form of scraping.
You must comply with all applicable national and international laws, regulations, regulatory acts, and regulatory rules regarding your use of the platform and services. The platform, its content, and all related rights shall remain the exclusive property of the Company or its licensors unless agreed otherwise. You shall not remove any copyright, trademark, or other proprietary notices from material found on this platform.
Definitions:
The following definitions describe other forms of content: A “Stream” refers to the online delivery of a recorded musical piece to an end user through the Internet, where the content can be heard or viewed but not downloaded for later reproduction.
Attempting or supporting others’ attempts to download, copy, distribute, modify, or record a Stream is not allowed. Reproducing and then re-digitizing any Download, Stream, and Preview is not permitted. The creation of any “derivative work” by altering any of the Content is prohibited. Using Downloads, Streams, and Previews in combination with any other third-party content is not allowed unless you obtain the respective rights from the copyright holder. Interrupting the Downloads, Streams, or Previews on the internet is not allowed. Sharing among users is strictly prohibited. Any other method of network sharing and transferring Downloads, Streams, or Previews to devices for this purpose is expressly prohibited and violates International copyright law.
Inappropriate Material:
The publication or sending of any illegal, threatening, defamatory, inappropriate, pornographic, or blasphemous material, as well as any material that could provoke or encourage behavior that would be considered a criminal offense or could lead to civil liability, is prohibited. By using the Platform, you agree to take full responsibility, and the Company bears no liability for any material that could be considered objectively unacceptable, inappropriate, or offensive.
Business Rights:
The services of Tracksaudio Play Exclusive are available for use in public broadcasting for cafes, bars, hotels, restaurants, shops, and special entertainment venues. Every user who uses Tracksaudio Play Exclusive at their business, must pay public performance copyright fees to the competent authorities of the country where they are located in order to be completely legal in the use of music and at their own exclusive responsibility.
Contact:
By creating an account, you grant permission to the Company to communicate with you at the provided email address. The services of Tracksaudio may include various announcements, such as offers, services, system management messages, and newsletters. Note that these announcements should be considered an integral part of using Tracksaudio’s services. As part of our privacy policy, we provide you the option to opt-out of receiving newsletters from us.
Charges & Payments:
Subscriptions for Tracksaudio’s services are available at monthly, 6-month, and annual charges. Payments are made once and cover the period of the chosen subscription. There is no automatic renewal for any subscription. Payments are made via PayPal only, which is one of the safest and widely accepted payment method for online transactions.
Refund Policy:
All charges are non-refundable. You are responsible for purchasing and paying the charges for all the access services required to use this platform. Tracksaudio offers music broadcasting across all its channels, with the opportunity to test the service for free before purchasing a subscription.
In case the server is not operational or there is an issue with music transmission through the automatic broadcasting system, Tracksaudio.com bears no responsibility towards your business. In this specific case, and only if there is an interruption in music transmission, and you are dissatisfied with the Play exclusive service, a refund can be arranged.
Limitation of Liability:
You acknowledge and agree that the responsibility for accessing and using the Play Exclusive services rests entirely with you. You also agree that Tracksaudio will not be liable for any direct or indirect damage, loss of profits, computer problems, or any other type of damages that may arise.
Tracksaudio does not guarantee uninterrupted, timely, secure, or virus-free operation of its services. The use of the Play Exclusive services is your personal responsibility, and you will bear the liability for any damage that may be caused to your computer equipment as a result of using or downloading material through Tracksaudio’s services.
Entire Agreement:

The terms and conditions constitute the entire agreement between you and the Company and supersede any previous understanding or agreement. These terms may be updated from time to time and any significant changes will be sent via email to registered users.
